Zyn Nicotine Addiction Lawsuits May Be Consolidated for Discovery Proceedings

A U.S. District Court has determined that a series of Zyn nicotine addiction lawsuits brought over the past few months should be consolidated before one single judge, to coordinate discovery and other pretrial proceedings into the claims.

There are currently at least four Zyn lawsuits pending in the U.S. District Court for the Southern District of Florida, each involving allegations that the product’s manufacturers, Philip Morris International, Inc., Swedish Match North America, LLC, Swedish Match USA, Inc., Philip Morris Global Brands, Inc., and PMI Global Services, Inc., should be held accountable for causing life-long nicotine addictions among young users of the flavored nicotine pouches. 

Zyn pouches are tobacco-free, smokeless products placed between the upper lip and gum, allowing nicotine to absorb through the mouth’s lining. While they do not contain tobacco leaves, the pouches combine nicotine with other ingredients to provide a discreet alternative to smoking.

However, use of Zyn pouches has grown rapidly in recent years, particularly among teens and young adults, prompting increased concern over addiction risks and marketing practices.

In response, several lawsuits have been brought against the manufacturers, alleging that Zyn is deceptively marketed to minors and falsely promoted as a tool to quit nicotine, claims that critics say may be fueling a new wave of youth nicotine addiction.

Given common issues of fact and law raised in complaints filed by Zachary Kelly, Kovadis Palmer, Nicholas Lendinara and Alannah Friedman against Philip Morris and Swedish Match, U.S. District Judge William P. Dimitriouleas issued an order (PDF) on May 30, granting the defendants’ request for consolidation of the complaints in the U.S. District Court for the Southern District of Florida, where all four plaintiffs reside.

Allegations Raised in Zyn Nicotine Pouch Lawsuits

Kelly indicates in his complaint (PDF) that he was influenced by Zyn’s marketing and advertising, which drove him to buy the company’s products as a teenager. However, he did not realize at the time that a single Zyn pouch allows the user to absorb more nicotine into their body than they would from smoking a single cigarette.

Palmer states in his complaint (PDF) that he started using Zyn products at the age of 20, and has suffered personal injuries as a result. He alleges that the defendants promoted Zyn in a misleading manner, similar to how tobacco companies promoted cigarettes for decades, making the product appear harmless and “cool” to young people.

Lendinara too claims he became addicted to Zyn products at a young age. In his complaint (PDF), he says that Zyn’s manufacturers promote their product as a healthier, tobacco-free alternative to cigarettes, which he claims is actually false, pointing out that Zyn’s nicotine is in fact derived from tobacco.

Friedman, who also became addicted to Zyn when still a teenager, claims that Zyn is marketed directly to minors, particularly through the use of social media influencers, referred to as “Zynfluencers,” and hashtags like “#Zynbabwe,” which appeal to younger audiences and promotes the product in a playful, trend-driven manner.

As a direct result of the company’s controversial and aggressive marketing messages, all four plaintiffs claim that they came to believe Zyn was not a tobacco product and would not be harmful to their health, both of which are false statements, according to their lawsuits.

“Defendants falsely maintain that Zyn is a smokeless nicotine replacement therapy from cigarettes or e-cigarettes, yet the nicotine concentration levels in Zyn exceed the levels found in nicotine replacement therapies,” Kelly states in his lawsuit. “Defendants have not received authorization from the FDA to market its product as a modified risk tobacco product or tobacco cessation device. What’s more, Nicotine pouches are available in a wider variety of flavors compared to FDA approved nicotine replacement gum or lozenges.”

The plaintiffs all raise allegations of design defect, strict liability, failure to warn and negligence against the manufacturers. They are seeking damages to compensate for injuries, as well as punitive damages.

According to the order issued by Judge Dimitriouleas, the lawsuits will be consolidated for discovery purposes only, to avoid wasteful duplication of judicial and other resources. As part of the coordination, the parties have been directed that key witnesses can only be deposed one time for all of the related claims, with a standard 7-hour time requirement to each deposition.

If lawyers are unable to negotiate Zyn lawsuit settlements following the coordinated discovery proceedings, it appears likely that the court may schedule separate trials in each claim in the future.
