Wage and Hour Lawsuits against Wal-Mart Settled for over $350 Million

Last week, Wal-Mart Stores, Inc. announced that they have agreed to pay between $352 million and $640 million to settle 63 wage and hour lawsuits filed against the retailer in 42 different states. The lawsuits accused the company of cheating hourly workers by forcing them to work through breaks and not paying them for overtime.

The wage and hour violation settlement may set a new standard for other companies who have been failing to pay employees according to the requirements of federal labor laws.

In recent years, federal court wage and hour class action filings have surpassed employment discrimination class actions, with claims involving issues such as misclassifying employees as salaried or independent contractors, failing to pay for “off-the-clock” work or on-duty meal breaks, denied reimbursements and miscalculation of commissions and bonuses.

Class action wage and hour lawsuits against Wal-Mart have generated a significant amount of media attention, as the retailer is the largest private employer in the world. The company has lost high profile lawsuits over wage violations in California in 2005 and Pennsylvania in 2006, which resulted in verdicts of $172 million and $78 million respectively for Walmart employees in each state.

Earlier this month, Wal-mart agreed to pay $54.3 million to settle a wage and hour class action lawsuit brought on behalf of workers in Minnesota, after a judge found that the company had violated wage and hour laws more than 2 million times.

Under the terms of this latest settlement, current and former employees in 42 states will receive at least $352 million, and the payments could reach $640 million, depending on the number of claims submitted by affected workers.

According to the New York Times, the Walmart settlement resolves all but 12 pending wage and hour lawsuits against the company. Some advocacy groups have suggested that Walmart settled the claims to avoid becoming the target of increased wage and hour enforcement that is expected under the Obama administration.

    I called to find out where my check was from Washington and California. I was told California was paid in August..odd..where is my check? I received the w2 for Washington’s settlement in Sept. I believe. I called to see where my check was to be told I was not in the system. WTF!!!!??? So I was sent a w2 I sent back but I am not in the system? Typical bullsh!t.

    I have read all of your comments we all seem to differ on what we feel about Wal-Mart I worked for Wal-Mart from 10-15-1988 until 08-20-2007 and let me say it was a hella ride.I truly enjoyed my job Customer Service was my middle name I didnt apply for a job I applied for a CAREER! But Wal-Mart didnt cause me my stressed induce high blodd pressure.Wal-Mart didnt cause me to pass out in the store from pure exhaustion from working 19 straight hours with 1 30 moniute break.It was the People Wal-Mart hired and entrusted thenm to do the right thing Every time I hear about a class action siut Im going to joined I have ALL my Documentation of foul treatment and unfair promtion practices froom this so called great place to work.I started as a layaway sales clerk worked my butt off to make Asst.Manager and was treated like crap from upper Management.AS a trainee we clocked in and out but were not payed for all our hours we were told its was just a formally thing they do until we got out of the management program.I was not paid the same amount of my as my male counter parts either and had more experience than they also women have to work harder than the guys and District and Store Managers do have good old back door meetings I have witnessed it they play good guy bad guy when things are not going there way after all the unfair work practices and seeing first hand how they will boot out hard working people for not corforming to crazy made up rules I had had enough.SO TO ANYONE THAT HEARS SEES A LAW SUIT AGAINST WAL-MART FLIE YOUR PAPER WORK!!!!!!!!!     I worked there for almost a year my first time and i worked night shift and i never got to get my full breaks in. The manager would always come in the break room and ask me to come and finish a end cap because they were afraid that the store manager would get on there case, many times i had to stay pass my shift and they wouldnt let me keep my overtime so i would have to kill it by the end of the week, i was a hard worker and sometimes i felt like i was getting taking advantage of.

    I worked while pregnant in 2004-2007ish. I used to work 16 hours straight with hardly a break or lunch. This was a store in North Alabama. Wal-Mart sucked as an employer. They don’t really listen to their employees and their needs. All they worry about is making sure THEY make that money!! You would think as a big corporate company they would be able to provide better insurance and benefits for their employees but NO! It all sucks unless you are one of the “big wigs”!!

    I walked out on my job this past week because I was not getting my breaks in a timely manner. Our on line schedules along with the schedules posted at work and at the csm podeums clearly states what time your lunch should be. I have been a cashier for almost 4 years at wal-mart and have worked there a total of 10. I have been told no by the csm one to many times when asking for my lunch break, i should not have to ask in the first place if they would just do their job and make sure everyone goes on break and returns from their breaks on time we would not have this problem. On this day I asked for my lunch which was 30 minutes past due already and the csm told me no we were to busy. Later she came by and said the other cashier in front of me was due back in 3 minutes then I could go. the other cashier astill had not returned in the next 15 minutes so I turned off my light to keep anyone else from getting behind the already 6 customers waiting. when the csm saw i had turned my light off she then sent someone over to relieve me but wanted to talk to me first. I was then taken into the cash office where she preceded to get in my face about the break schedule. Instead of yelling back at her I just handed her my badge and told her I had had enough of wal-mart and their way of doing things. Other cashiers go on their 15 minute breaks and are gone anywhere from 30-45 minutes, they dont get in trouble because they are the csm friends, others are gone 13 to 15 and they are being paged back to their registers. I talked to the manager of the cashiers and she went to bat for me but wal-mart said i abandoned my job so that was it. What about my rights? I have the right to get my breaks on time and being told no is wrong. several times my name had been marked off the list as went to break but they never told me I could go so either the break was extremely late, or they said to take it with the lunch break, or i missed it altogether. when I asked for my break i was told oh your name was marked off and so and so must have forgot to tell you to go. Bull Crap, they just didn’t want us to go because we were to busy and they care more about the customer than the employee.

    I worked in the tire lube express for 4 years, from 2000 to early 2005. I was a support manager the last 2 years of that time and I feel I did a good job at it. The department manager left and they brought in a man from another store to run the department. one day he called me into the office and he said they were cutting 2 of the support manager jobs (there were 3 of us) and I was one of the 2 getting cut, since I was leaving a manager job I could no longer work in the department and he sent me to hardware to work. about 2 weeks later he brought in a young man from the store he came from and put him in the same position I was just taken out of. What? they cut supportmanagers just long enough to get the woman out? I called and complained to home office but no one did anything about it. I talked to someone in their ethics department and they did nothing. I feel because I was a woman he wanted me out and he put his buddy in the position. This same manager was fired shortly after that for stealing so I feel he got what was coming to him but wal-mart did me wrong. They cut my pay $1.30 an hour.the dollar was the raise I got for becoming support manager, the 30 cents was register pay, then when I went to being a cashier they didn’t give me back the 30 cents they gave me a 3cent raise? how did they figure that one out?

    I started working at walmart in April 2007 and was 7 months pregnant they started me in garden center where i was forces to lift the heavy BBQ”s up onto the shelves i was never allowed to leave to use the bathroom and never got my breaks on time when i would go past the 6 hours the register would lock me out so i would have to just stand there looking stupid waiting for some one to come relieve me. My doctor had to take me out early on maternity leave because all the stuff they made me do was putting me into preterm labor then they replaced me so when i was able to return they had to figure out where to put me i then went to over nights where i was massively harassed by my boss she was continually threatening to fire me because she did not like the fact that me and my current husband met there and were dating i worked there for a year and a half before i finally quit then two months later they fired my husband for no reason and when unemployment called to find out why he was fired they lied three different times to unemployment so he was finally able to receive unemployment

    I guess the new trend of walmart abuse comes now with the coaching (writing-up) of associates who call out sick even if they have a Doctor’s excuse. The management’s position is that even though you’re sick and you called-in; showed doctor’s proof; that they have the right to coach you for not performing your work. (even though you’re not there) so, they can coach you for either being sick, or for performance not getting the job done. Salary members of management are, of course, not penalized for doing this. In summary: Wal Mart associates need a Union!!!!!! specially the worst wal mart ever store 5193 in Moreno Valley, CA. if you work there, get the H*** out as soon as you can. If you need a job. do yourself a favor.. don’t work there!!! please, please, you’ll regret it ~!!!!! and lastly, if you can afford it go buy elsewhere! that is the only way we can slow down the big “ABUSIVE” giant.

    i work for wal-mart for 5yrs and i was nevfer late or absent out of five yrs til this last dec we had a bad storm with the snow, but then i wentpo work nextt day.this job was very stree ful but but by my faith i had in me i stock it out.there was very rude mgers who spoke very nasty and there was some nice ones, mr frank was a very fair person and was supportive then there was mrs ruth who was there she help us out me and her talk a lot, some didnt understand her .then as more came in the place got out of hand and out of contol,people disresect others ther was no write ups or talking to,the peoples always was there, me i try alwasy to do the best at all i could and give a hand anywere.,in 2011 new manger came in started speaking he was get ride of all the people who was here with old mg there making to much, this he did with comming up with lyes on people who had departments and been with the company for yrs and did good job then he work nthis way down to me,i began9hr and work my way to 11.5 dollars and that when the crazy harrassment came,i was determated for no of a policey that was not made in the book i have since 05,walmart makes up rules everyday different with no book you can’t trust them

    my daughter has worked for walmart for over 10 years. She feels threatened by shady customers who seem to stalk her while she is working the register. They sit on the bench for hours and watch her. Her complaints to management fall on deaf ears. The police say they can’t do too much since it is private property and it is up to the manager to get rid of the loitererers. She has asked numerous times to be transferred, but is threatened with part time if she should leave. She believes there are possible drug dealings going on in the store, and that these people think she knows it, so she is worried about her safety. The manager and the associates ignore her pleas, so she is a basket case right now. I have told her to just leave and take the part time job, but she needs the money at this time. If anything happens to my daughter, can I sue Walmart for allowing her to work in what she and I perceive to be a hostile work environment???

    I worked for walmart eight years, I started as a cashier and was eventually moved to a customer service manager my rate did not move for years i was never offered a raise I was told I had to earn it. I thought I did as much running around I did helping my customers with any problem they had, I left there only making 7.65 for a accumulation of eight years. I knew that wasn’t right not at all..Because I had friends that got their raises I deserved mine too. It’s been a while since I worked there but I just wanted to share my experience.

    I worked for Sam’s Club since 2000 a lot of times I did not get my breaks or lunch because my manager was never available to relieve me instead she would send me home 30 minutes early to conpensate for the 8.00 hours worked without break or even having lunch. I got promoted to a salary manager after that and the only reason I took that position was because I needed the money, now I realize that I wasted 11 years of my life working for a company that does not care for their employees I missed spending time with my family, I currently having a lot of health problems because of all those time that I worked 8 hours without having anything to eat. Dawn Company I would never work for them again they suck the life out of. The preach about respect for the individual, open door policy no descrimantion but all that is (BS) specially at club 4824 starting with the Market manager Jeff.

    I worked for walmart for 12 years loved my job had never been wrote up or had any problems with them then they started getting rid of older employes within a month i was wrote up time after time until they told me to give up my position or 2 more write ups and they would fire me and the position they offered me i had never worked ,would not give me something i knew how to do although there was somethig open they hired off the street they wanted me out so i finally quit and it hurt me so bad that they would do that to me, walmart is a dirty company to work for and i hope the worse for them they dont care what they do to people .

    Walmart is doing exactly what everyone is saying..it may not be going on in ur state but it is happening..I was there from 10/1996 to 1/2009 I was a department manager earning 12.30 hr. Fired for workin 15 minutes over a week before Christmas!! And they couldn’t PROVE IT!! What a CROCK!! I was a single mom of three on our own. Six months later in August, they hired me back (desperate to feed my kids) part time at 7.80 hour..What a slap in the face!! I had over 10 years in retail experience from them!! You bet we were expected to work on our breaks and lunches..if you were called to the floor, u better get ur ass out there or else..thats how they work.. I WANT TO KNOW WHO IS HANDLING THE LAWSUIT..I HAVE PLENTY TO SAY!!

    I have been applying to wal-mart for going on 2 years now. First the excuse was because I was still in high school but two boys that were younger than me (I was 18 when I first applied) got jobs there as cart pushers with no trouble. Then I was told they were only hiring part time (thats all I was looking for), I had marked part-time on my application. There are also guys who get hired to stock for 3 hours because they have another job to go to, but I have open availability. I even know some males who didn’t complete their assessment on the application and still got called in within a week to go to work after a 5 minute interview. Every time I ask a manager about any openings they say they have put a hold on hiring but the next week theres 5 new people working, whether it be morning or night. Lets put it this way, this walmart is every understaffed, even the employees will tell you so but they won’t hire any more females. And I know 3 females who have quit to pursue other work because wal-mart refused to give them hours, and they would frequently have to work through their breaks.

I worked for the business for five years and was not apprepriated for my work performance left in the same position and told over many new employess that I did not qualify for other positions and then terminated.. Their is a lot of favoritism within managemement in the Bradford County, Starke Fl area.

    Walmart has unfair labor practices with male and female employees. I work for the company for over five years and always told I did not qualify for noting but a cashier. Never was I apprepriated for my hard work and not given a raise in two years. When I complained was given the cold shoulder by upper management and ignored. My complaints was passed from one manager to another to handled but never resolved. On several occasions, I was ignored and not given a break, late lunches, denied raises. I worked for the company since 2005 to 2010 and let go right before my evaluation and time for an updated raise. When I was in an car accident in July 2010 and out for three days, call into the office and let go by management and forced to signed paper work which I have a copy. I asked was it due to my car accident and told no but not given a reliable explanation.

    I worked for Wal-mart for 5 years and did more than my fair share of cross training and helping out in other depts. I was hired and trained to work in shoes but I also helped out in lay-a-way, crafts, hardware and even cashiered when they neede me but when my mother became terminally ill and I needed someone to lean on, they weren’t there. They did all in their power to make it the worst possible work environment ever and get me to quit. I stayed strong but they eventually filred me for it. They know they were wrong because they had the nerve to tell me on the day they let me go to “please come back in 6 months and reapply because you are a good employee and we’d love to have you back.” Seriously?! I know that they were just trying to save having to pay me the hourly rate I was making and they were trying to cut back on benefits. Anyone who thinks Wal-mart cares? You are a dime a dozen and you don’t mean anything to them unless you stand in the way of them possibly getting a bigger bonus. I also remember an assistant manager who actually had the nerve to question my religion and reasons for taking off work to attend church.

    I’ve been working for Walmart for 18 years now, it took me 15 years to finally get picked for a supervisor position. I was a department manager for 2 years and after that Walmart decided to cut positions and save money, so they they told me and 6 other’s to step down and take a lower daytime position or go on 3rd shift and stay full time. I decided to go on 3rd and keep my full time hours, but i’ve lost some money. I was promised that when another supervisor position comes open in the future i will be considered. About a year has past and 4-5 positions as supervisors had been opened, but i had been lied to because they were given to other people with no experience and they was men. Then i was asked to train some of them, i refused to do so. I was a stocker on 3rd shift which is a job code 2. But since i had manager experience they used me in the backroom as an ICS, which stands for Inventory Control Team, and is a job code 5 which gets payed higher than a stocker. They never payed me the differential, nor did they change my job code. After 1 year i asked the store manager if he is going to make the job code change since i’ve been working not as a stocker but an ICS in backroom. He kept saying he would but never did. After 3 month i’ve called the Lady from Human Resource and explained my situation to her. She said that she would have a word with my store manager. I waited again for a few weeks and nothing happened. I tried calling her one more time and left a message. After that a few days later i was assigned back to the floor as a stocker which i was anyway. After that time i wasn’t used in the backroom any longer. Now i’ve been harassed and they trying to work the hell out of me. I am in my early 50’s now and my Health is going down the drain with the way they treating me. I guess they can’t wait for me to quit. I haven’t gotten a pay raise in 2 years since they are saying that i am maxed out as a stocker. The only way for me to make more money again or get a yearly raise would be if i get a higher position again, but they make sure this would not happen.

    I would like to know if there is any way to ask law and labor to check out how they are working there employees down in texas I am currenty running a bakery with only 5 associates. when it is time for us to have are days off it only leaves three ppl running the bakery with no help or support from our so called zms or assisant managers. Top it all we have our store mgr juming down are throats to get the floor filled up and on top of it all NO OVERTIME ALLOWED they have signs posted saying we will be coached if we get a second on overtime

    I worked for Wal-Mart for 8 years and I worked many days without lunch in order for my employees to get their lunch. I was Head CSM for Wal-Mart. I live in Georgia and I never recieved a letter concerning this lawsuit. I trained many people in the position that I held.

    My husband worked for Walmart for 5 years and has a learning diasbality and they knew that when he was hired back in the year 2000 and he was with the company for 5 years and had a really good track record. he got sick had to use that family leave act and take some time off than he returned to work completely better they got a new store manager that did’nt like him. H was asked to go home early by the personal MGR due to another worker was injured in a car werck and come back and hour early the nexted morning so thats what he did. But the nexted moring he was fired. The store MGR stried to say it was because of his tardieness and sick call in days. I was like what and I looked at the paper he gave him and I remeber that my husband had just had his 5yr eveauation and he was with in company guidlines not even a week before this happned so I loked at what the guy wrote and conpared the tow and explained to my husband that he was wrongfully fired. We fought for his UIE benifets and I can tell you we won because we were in the right. So if you ever get fired from Wally World as I call make sure its valid. I alos found out that once your invested into the company at 5 years they find all kinds of reson to fire you. Thats what happen with my husband. Now we are much better off he has a job he loves.
