Ticketmaster Data Breach Notices Provide Customers Only Limited Fraud Protections

Customers impacted by a massive Ticketmaster data breach are only being offered one-year of TransUnion credit monitoring membership, despite lawsuits alleging cybersecurity failures exposed sensitive customer information.

Following a massive Ticketmaster data breach reported earlier this year, which exposed the personal information of hundreds of millions of customers, the company has begun sending notices to customers by email, offering only limited fraud protections.

In a report to the U.S. Securities and Exchange Commission in late May 2024, Live Nation, the parent company of Ticketmaster, disclosed that hackers were attempting to sell customers’ personal identifying information (PII) on the dark web, after the data was taken from Snowflake, which stores online information for numerous different companies.

It now appears that the massive Ticketmaster data breach was the result of a cybersecurity failure, which allowed the hackers to access the names, contact information, card payment information and other personally identifiable information of roughly 560 million customers.

Millions of customers are now being notified of the data breach by email, informing them they have limited time to sign up for a free identity monitoring service through TransUnion, which will only be valid for one year before customers must take on the expense themselves.

However, Ticketmaster customers who have been impacted by the data breach have expressed the one year fraud service is not enough to protect victims, and that the potential for damage from such a breach extends well beyond the span of a single year.

As a result, a growing number of Ticketmaster data breach class action lawsuits are now being filed, seeking additional protections and financial compensation, alleging that inadequate security measures by Ticketmaster and Live Nation led to the release of customer personal information.

Ticketmaster indicated that an additional number of new measures have been taken since the breach, which include rotating passwords for all accounts, reviewing access permissions, as well as increasing alerting mechanisms.

Ticketmaster Data Breach Lawsuits Seek Additional Damages

Ticketmaster’s offer of merely one year of credit monitoring has been widely criticized as insufficient by victims, who argue that the potential for damage extends far beyond this limited timeframe.

Several Ticketmaster data breach lawsuits filed to date outline how the risks associated with data breaches are enduring and can emerge years after the initial incident, and that Ticketmaster customers who have been compromised are entitled to actual damages, extended credit monitoring, and other monetary relief.

Many of these victims are seeking legal representation to pursue compensation for their actual damages, which include both out-of-pocket expenses incurred from dealing with the fraud and the broader financial impacts.

Given common questions of fact and law raised in a growing number of Ticketmaster lawsuits being filed throughout the federal court system, a motion to transfer was filed with the U.S. Judicial Panel on Multidistrict Litigation (JPML) in July, requesting that lawsuits filed throughout the federal district court system over the Snowflake data breach be consolidated for pretrial proceedings before one judge.

The JPML is scheduled to hear oral arguments from both defendants and plaintiffs on whether to establish a Snowflake Inc. Data Security Breach Litigation (MDL No. 3126) on September 26, 2024 at the Fred D. Thompson U.S. Courthouse and Federal Building in Nashville, Tennessee.
