Nerve Damage Lawsuit Alleges Knee Replacement Surgery Malpractice

A medical malpractice lawsuit has been filed against two Illinois doctors following a knee replacement surgery that allegedly resulted in nerve damage.

The complaint was filed by Dave Gutjahr on March 19, in St. Clair County Circuit Court. The defendants include Dr. James Bolvin, Dr. Steven Horner, Protestant Memorial Medical Center Inc., Anesthesia Associates of Belleville and Belleville Orthopedic Surgeons Ltd.

According to the lawsuit, the two doctors performed knee replacement surgery on Gutjahr in August 2009 at Protestant Memorial Medical Center, but after surgery he began to feel numbness in his right leg, where the knee surgery took place.

The complaint alleges that medical personnel repeatedly told Gutjahr that the numbness was a temporary side effect of the surgery which would be alleviated over time. However, the problems did not go away, and in March 2010 Gutjahr was diagnosed with nerve damage from the knee replacement surgery, which is likely permanent.

Gutjahr’s lawsuit accuses the defendants of negligence for the knee replacement surgery, seeking damages in excess of $375,000 for ongoing physical pain, mental anguish, disfigurement and loss of his ability to perform certain functions due to his injuries.
