Lawsuit Filed Over Wal-Mart Pharmacy Error

A pharmacy malpractice lawsuit has been filed by a Texas man who alleges that he became sick and was hospitalized after a Wal-Mart pharmacy error resulted in him receiving someone else’s medication. 

The lawsuit was filed last month in Jefferson District Court in Texas by Emile Joseph Nini. According to a report in The Southeast Texas Record, the complaint includes Wal-Mart Stores Texas, Wal-Mart Pharmacy and pharmacist Cindy Lee Carraza as defendants.

The lawsuit alleges that a Walmart pharmacy error resulted in Nini receiving the wrong drugs, and the defendants failed to notify him that they mixed up the medications after the error was discovered. The complaint also indicates that the Walmart pharmacy failed to use safety measures designed to prevent such a mistake and failed to meet acceptable standards for dispensing medication to consumers.

After taking the incorrect medication, Nini was hospitalized in Mach 2008, suffering bodily injury and physical impairment. He is seeking an unspecified amount of damages to compensate for his medical fees, pain and suffering, mental anguish and physical impairment.

According to a 2006 report by the National Academies of Science’s Institute of Medicine, there are about 1.5 million medication errors every year that result in injuries. These mistakes are largely preventable and could be caused by a doctor prescribing the medication incorrectly, the pharmacy filling the wrong dosage or by nurses dispensing a different patient’s drugs.

    Walmart pharmacy overcharged for medicine saying they had to change manufacter. It was same bottle and label like other.

    I too was given the wrong medication by a Wal- Mart Pharmacy in South Carolina. The medication bottles were correctly labeled with the medication that I was prescribed, but the actual medication in the bottles were NOT the correct medication as the bottles were labeled. After taking this medication for a whole month as prescribed, it put me in the hospital for a week. When I returned home the following week, I received a letter from Wal-Mart Pharmacy warning me of the mislabeling of the medication I purchased.     i was also given the wrong prescription in 2017 by pharmacy in fayetteville nc .they never let me no.

    Walmart Pharmacy in Dallas, Tx on forest ln, gave me a lower dose or a generic bran of Lunesta sleeping pill 2mg and told me it was from another company. i usually get 3mg pill that is blue. The pill they gavr=e me is white. lunesta 3mg put me to sleep fast and I wake up feeling fresh with no side effects. But the lunesta 2mg white pill make me have nightmares and I tend to sleep untill noon.     On 12/26/09 I died 3 times and as revived due to ingesting Calcium Ascorbate Crystalline Powder by NeutriBiotic. I hemorraged internally and had to have a 1/2 gallon transfusion. I am still suffering. The product did not have any WARNINGS, SIDE EFFECTS PRECAUTIONS. The company is being sued by the California AG on another product containing a Cancer Chemical.
