Ford Focus, Fusion Class Action Lawsuit Filed Over Power Steering Issues July 9, 2014 Irvin Jackson Add Your Comments A class action lawsuit has been filed against Ford Motor Company, alleging that the power steering system in some Ford Fusion and Ford Focus vehicles is defective and could increase the risk of drivers getting into auto accidents. The complaint (PDF) was filed late last month in the U.S. District Court for the Northern District of California by several plaintiffs, including William Philips, Phillip Clay Cecil, Robert Halsey, Temple Halsey, Performance Fire Protection, LLC and Jason Wilkinson. The lawsuit seeks class action status to represent anyone who purchased a 2010 through 2014 Ford Fusion or the 2012 through 2014 model year Ford Focus. According to allegations raised in the lawsuit, all of the Ford cars targeted by the class action claim use the Electronic Power Assisted Steering (EPAS) system, instead of traditional hydraulic-assisted power steering pumps. The EPAS system uses a steering control motor, electronic control unit, torque sensor and steering wheel position sensor to help the driver navigate. Learn More SEE IF YOU QUALIFY FOR COMPENSATION “The EPAS system, however, suffers from systemic defects,” the lawsuit claims. “The multitude of defective elements in the EPAS system renders the system prone to sudden and premature failure during ordinary and foreseeable driving situations.” Plaintiffs claim that the system seeps conforming coating onto the ribbon cable, causing loss of connections, the ribbon cable pins are misaligned, causing loss of connections and breakage of critical wiring, the contact plate can corrode, and there are defects in the system’s sensors and gear assembly. The lawsuit indicates that the Ford steering problems result in significantly increased effort needed to control the vehicle, and can cause drivers to get into an accident. Ford is allegedly aware of hundreds of complaints, according to the lawsuit, but has failed to act appropriately to ensure consumer safety. The complaint accuses the company of intentionally concealing the problem. None of the plaintiffs claim to have been in an accident caused by the steering system. The lawsuit points out that not only has Ford received complaints, but so has the National Highway Traffic Safety Administration (NHTSA). The lawsuit claims that the agency has received about 450 complaints of sudden failure of power steering loss regarding the affected vehicles. A number of those resulted in crashes and injuries. The claim accuses Ford of violating consumer protection laws, fraudulent concealment, unfair competition, false advertising, breach of warranty, negligent misrepresentation, negligence, unjust enrichment and fraud. I plan on calling the dealership to get it checked – there should be a recall on this issue – I hope. Cathy October 19, 2014 I have the 2011 Fusion SEL AWD. What a nightmare. This has happened so many times , it is very scary but what can I do? I owe ten grand on it , would love to sell it to a Ford dealer. The worst failure was driving over the Sagamore bridge going to Cape Cod. So very scary. Louella October 17, 2014 My MOM’s Quote “IT WENT OUT TOO SOON!” And she is correct, read her story about 2012 Ford Fusion Power Steering Assist Module Defect. It’s been a nightmare (for our family) ever since our mother’s (Louella Ashford) Power Steering Assist Module went out (Jul 15) on her 2012 Ford Fusion only to discover, her car was no longer under MFG warranty and she was handed a large bill of $1800 originally; we contacted FORD Customer Relations, NHTSA, BBB Auto Line, and the Federal Trade Commission. You can review all details below but the main issue is this is a “ Major DEFECT” and FORD will not own up to it. The warranty doesn’t matter, if it was a recall (as it should be) FORD would have paid for the repairs anyway. My mom was not explained ”Extended Warranty” when she purchased the car and why would something major go out at only 36,744 miles? Shame on Ford it was only 744 miles over, I’ve been told normally they would pay for such low mileage over MFG’s warranty. I want the entire complaint letter sent to FORD Customer Relations, CEO, COO, whomever will listen. We have been given the run around from FORD and Tim Castellaw dealership, shame on FORD. I want this letter on your website since you have FORD rated A+. They are not running an A+ operation. They DO NOT care about their customer. My mom has made every car payment on time, what we call an Excellent Paying Customer and Ford is only saying I am sorry, they should be more than happy to pay for the repairs. My mom wants FORD to reimburse repair expenses (she does not have that kind of money and she should not have to pay for something such as this). (And as her daughter, Judy Jacob, I am here to help her. I have been in customer service 20 + years and never experienced such Poor Customer Service and normally I go through you, BBB and get great results. I depend on your website for positive and negative reviews before I make decisions now.) Tim Castellaw Ford Dealership (repaired her car) only took the price down to $1101.03 because the person my mom purchased the card from got involved. She still should not have to pay a dime. This car is too new to have a major part go out. And its all over the internet with other customers having the same issue. Please review and forward our complaint to FORD: HERE ARE HER DEMANDS: Ford reimburse $1101.03 for repairs Ford compensation for all the days she went without her car, totaling 31 days @ 42.98 (daily rate of compact rental) = $1332.38 Ford pay for extended warranty to “Warranty Company of her choice; valued at $2895 for up to 100,000 miles. Ford reimburse July’s car payment to her of $303.45 ED October 14, 2014 I have a 2010 Ford Fusion Hybrid. Before my warranty was over, I took it to the dealer with the same issue and they said nothing was wrong. I’ve put up with it for so long when it fails on me driving in the highway or sharp turns. Now that my warranty is over, I have the same problem, but this time it is steady and have trouble driving the car. I’ve spent so much money on this car thinking it will protect me. Now, I am afraid of driving the car! I’m so ANGRY with ford for supposedly an awarded car of the year. REALLY??!! Heather October 14, 2014 My husband and I have a 2012 Ford Fusion. Today while driving home from work the service power steering now and advanctrack light came on and I lost power steering. We could have very easily been involved in a car accident if I had been the only person in the car. My husband had to put excesive pull to help me drive. What is Ford going to do about this? Barbara October 13, 2014 Are you taking any class action lawsuits on Ford Fusion Hybrid -2014. Advertised at 47, reduced to 42, but I am getting 33. A true lemon and total deceit on the part of the Ford Motor Company. kimberly October 9, 2014 I have the same problem ford is making me pay 120 to diagnostic, then they say nothings wrong with it and they just reset it. The power steering went out while I was driving with my daughter in the car Chuck October 7, 2014 My wife just called , power steering went out on our 2011 Ford Fusion again, 3 times and resets itself. Thought it was fixxed on our recent PCM flash, that was part of another recall, obvious to me now not related. Ford dealer wants $2600 dollars, they state part alone is $1900 dollars. Car just out of warranty wow, Neither Napa or Lordco carry the part. Reeding Transport Canada has went after them to create a recall for this problem. I’ll have to find out the results (being Canadian on the west coast) and fast as this is her only transportation. Erin October 2, 2014 Had this happen with my 2011 Ford Fusion today. They are replacing the Power Steering Gear. Bought it pre-owned certified and have only owned it since June of this year. I bought the car after having tons of problems with an old hand me down SUV. Was so glad to have a newer dependable car. It has 70,000 miles on it. I was fortunate to be in my driveway when it happened. Got it towed to the dealership. I’m very disappointed. I had a 1995 Explorer for 15 years and put 285K miles on it with no problems. Which is why I went back to Ford. Tenecia October 2, 2014 Please help. This is ridiculous. How do we get to the bottom of this. Are we just stuck paying $ 14,000 for a car that may need a $2100.00 repair. Randomly over and over throughout the life if the vehicle. Its only 3 years old. Derek October 1, 2014 Same song same dance 2011 ford fusion sel. 64,234 miles, When into considerable debt buying the Car for my wife, to have safe and conformable transportation for her and my son. Power steering assist Fault Came on and rendered power steering useless while my wife was driving, Needless to say if either of them were brought any harm because of this issue I would have gone vigilante on ford motor co.. 2000$ repair from any dealership without a for sure cure has been the only vague remedy I have found I have owned a Mustang Ranger and Now a fusion all was love until the fusion this will more than like be my last Ford vehicle,,, mark September 30, 2014 i just bought a 2012 ford fusion 1 year ago, it lost power steering 4 times usally a few months apart, i luckily didnt crash and was able to pull over , shut off the car, re start it and the power steering assist fault went off and regained steering agian,, when taking it to the dealer, they said the warrenty doesn;t cover it and it would be about 2 thousand dollars to fix,, whitch i dont have ,, its been out for a month now and they refuse to do anything to fix it , im a single dad with 2 girls, and even when it was working i couln;t trust that we could crash because of ford;; could you please help me ,,,,,sincerly mark Melissa September 23, 2014 2010 Ford Fusion lost power steering with my 5 year old in the car, Took it to the dealer 1486 just in parts to fix it. It is the EPas system. Filed a claim with Ford and a complaint with NHTSA. Darren September 22, 2014 My wife and I purchased a used 2011 Ford Fusion in January 2014 as a backup car from our local Ford dealer. The car had about 22,500 miles on it. Over the past nine months we used the car about 10 times and put 3000 miles on it. This past Friday evening we came out of a store and started the car and the steering wheel was stuck and very hard to turn. The message on the dash said, “Service Power Steering”. We had the car towed to a Ford Dealer in Richmond, VA. They called me and said that electronic component needed to be replace. They also told me that the front tires on the vehicle were not the correct size for the car. Wouldn’d you think that buying a used Ford vehicle from a Ford dealer would have the correct size tires on it? I contacted the Ford dealer where we bought the car and there going to contact the Ford dealer in Richmond to see what the issue is. But to have the power steering do on a car that only has 25500 mile on it is crazy. After reading all of these reviews about power steering issues I think Ford needs to recall these vehicles before someone gets hurt and they get more lawsuits against them. Haven’t heard if the dealer will fix it under warranty but we shall see. Daisy September 22, 2014 We bought our daughter a 2012 ford fusion and her vehicle also has lost power steering due to the advanced Trac and power steering assist fualt. Come on Ford step up and recall this problem before it causes somebody to wreck! Jakita September 20, 2014 This happened to me today. I have a 2011 Ford Fusion and my powersteering went out. I called the dealer to see if their was a recall on my car for this issue but they hung up on me. This is a really scary thing to not deal with. Ford needs to handle this now. AP September 20, 2014 two weeks ago i was driving about 70MPH and Power stearing service now sign came on and stearing wheel got locked. i almost got in to an accident with semi truck and could have died. i took my car to ford dealer they wants to charge $2000.00 to fix rack and pinion . i was thinking about getting if fixed, but steraring wheel came back to life so i did not get it fixed, but again yeaterday i was driving out of state and on freeway driving 50MPH and same thing happened again and i have no clue how to take this car home again. it’s 2010 ford fusion with only 28,000 miles on it. there are many complaints about this out there and still no recall. rachl September 20, 2014 same issues 2010 ford fusion just had car 6 months….60,000 miles on car stated there is no recall on car but clearly there is an issue stating I need over 1700 for reparir kevin September 17, 2014 Just experienced the same power steering issue on my 2010 fusion. Cost was 2200.00. My car has low miles and should not need this kind of repair just out of warranty. This is getting ridiculous. Make sure to report. rick September 15, 2014 I have a 2012 ford fusion and my vehicle also has lost power steering due to the advanced Trac and power steering assist fualt. Come on Ford step up and recall this problem as we put our investment in your product and in supporting an american product please support your customers or we will all start buying Toyota’s. Lonnie September 15, 2014 My wife went to the store. When she came out to leave, the steering wheel would not turn. She called me. I started to go get her and she called me back and said it was working after she turned it off and restarted it. I went on line to see if there were any other people with this problem, and found a lot. I took it to the ford dealer and they checked it and said the power steering assist was bad. They had to replace the rack and pinion . Cost 1700.00. A few days after I got it back it started making a noises . Took it back to the dealer and they said the lower control arm was bad. They replaced them at no cost to me. If they are recalling other models for this problem they should recall the fusions. Mine is a 2012 model. James September 15, 2014 My parents own a 2012 Ford fusion and are having the same problems that I’m reading regarding the power steering suddenly not working making it impossible to steer the car unless you have arms like a body builder..iam finding out that the people at Ford are aware of this problem. I just wanted Ford to know that if something happens to my parents do to fords lack of concern that i won’t stop until Ford is liquidated and bankrupted and reduced to nothing but a memory. Paul September 11, 2014 9/6/14 I took my 2011 Ford Fusion to Ford Lincoln in Jonesboro Arkansas for the following service request: “Power Steering Assist Fault” occurs on starting motor. This has happened about six times so far. Today it happened as I was backing into the street from my driveway. Each time I have to turn off the ignition switch and restart the car. Then it has cleared and I have power steering again. So far, it has not occurred during normal driving, just after starting the car. Service report indicated U3000 code stored in P/S module and vehicle is going to need P/S Rack and Pinion parts $1186.74 + $170.00 Labor + $69.95 front end alignment=$1426.69 + tax. This in addition to $49.05 troubleshooting already paid. Service manager and general manager said there were no recalls or service bulletins that apply. I told the general manager there was no way a car with 89978 easy highway miles should need a steering box replaced and that obviously Ford had installed defective parts. He said there was nothing he could do other than refer me to Ford Customer Relationship Center which I contacted and received a case number. The result being that Ford refuses any responsibility for the repair or replacement of the defective part financially because it is out of warranty. Mike September 10, 2014 I purchased 2010 Ford fusion se, only 61,000 miles in SC. After 2 days, I was on interstate driving 75mph and Advance Track light came on and message “service power steering”. Steering got stiff but was able to safely pull over. Towed car to dealer, they “reset” system. Car drove fine but 2 weeks later, same thing happened again. Now dealer wants $2200 to replace rack & pinion but cant guarantee that it won’t happen again. After reading many complaints, it appears to be a software issue not hardware and needs to be recalled! I’m driving around knowing my steering will go out at any time. Scary!!! mark September 4, 2014 i have the same problom with my 2012 fusion , Jalaine September 2, 2014 I have only had my fusion since July 31,2014 and have already had three instances where my “power steering assist failure” light came on and my power steering went out. I drive my four kids around in this vehicle. I don’t at all appreciate seeing that Ford is taking this so lightly. This needs to be recalled. Douglas September 2, 2014 The power steering has faulted for about four months till it finally failed in 9/1/14 this was suppose to be a reliable car for my wife and teenage daughter but is not it the cost to fix is more than what we have to fix it we live on a fix income my wife and I can not afford 2000.00 car problem Lorraine August 25, 2014 I am the owner of a 2012 Ford Fusion and just this past Friday, my teenage son was driving the car to college and all of a sudden it stopped on him in the middle of the road (busy intersection). He was able to turn it back on and make it to a parking lot on campus. When trying to back out of the parking lot, the steering wheel would not budge and the indicator lights came on for Service Advance Trac and Service Power Steering. Needless to say, he was stranded as I was 5 hours away. I immediatley contacted the dealership I brought the car from and they verified that I had purchased an extended warranty for my vehicle. One would be delighted to hear that, only that I am still waiting on the insurance company to say that they will pay out on the Electrical Issue that has nothing to do with normal wear and tear maintenance. We all know how much of a hassel it can be dealing with insurance companies. Nevertheless, I had my car towed by my personal insurance company to the nearest dealership (by the way it’s closed on weekends) so I had to let it sit in the parking lot for 2 days. I got a call from the dealership today, that the EPAS Electronic Steering gear is bad and needs to be replaced. Imagine me hearing that the bill is $1800+ dollars. I am waiting to hear the final verdict on payout from the insurance company and will update as it becomes available. I am blessed that my son is alive and well and that he did not get into an accident, but who knows what will happen the next time this part goes out ! Praise God. doug August 18, 2014 I have a 2012 Ford Focus experiencing difficulty with the electronic steering. Goes out periodically. I would be interested in being part of a Suit against Ford as they have no interest in helping me out. They want 1700 for a whole new Rack and Pinion that does not even appear to be the problem. How do I get ahold of the attorney? ROBERT August 16, 2014 I OWN A 2011 FORD FUSION AND FOR THE PAST YEAR MY POWER STEERING HAS BEEN RANDOMLY FAILING WHILE DRIVING. ON 8/13/14 IT FAILED FOR GOOD. COST TO REPAIR: 1987.73. CONTACTED FORD TWICE ABOUT THIS ISSUE AND THEY OFFERED NO ASSISTANCE IN GETTING THE CAR REPAIRED. Ryan August 11, 2014 We own a 2014 Ford Fusion, and have had the warning “Steering Fault service now”. When the vehicle was turned off we would lose power steering when it was turned back on. Happened during an emergency road trip across the country. They refused to give us a rental car after we paid thousands for the extra warranties. The amount of time lost was horrible. We had to go to three different Ford dealerships across the country to get anything done. We never did lose power steering while moving, but the car has less than 12,000 miles on it. Amber August 7, 2014 We own a 2011 Fusion and we’ve just not started to encounter this same issue. TWICE this week my power steering has failed, thankfully my children were not in the car and it did not cause an accident. I’ve called both my dealership, where we bought the car brand new, and Ford Corporate where I’m being told there is no recall and that we’ll be responsible to repair this dangerous issue. I’ve been an avid Fusion fan since my first (This is our second fusion), but I’m not so sure about Ford now that they don’t take safety issues seriously. Susan July 30, 2014 I have a 2012 Fusion and my steering has gone out. Thankfully it occurred when my vehicle was parked. When I came out of a store and cranked it…ALL the idiot lights went off and no steering. I have taken it to Ford and they say they are not aware of any issues with the Fusion. They are happy to charge me $1900.00 to repair the problem. As for now it suddenly starting working fine. I am so nervous driving it!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Sandra July 23, 2014 I just bought my 20 year old son a 2010 Ford Fusion a month ago and last night his power steer failed. Luckly it happened when he was pulling into the driveway last night. lisa July 22, 2014 i have a 2011 ford fusion 6 months after buying my car my family and i were out driving when all of a sudden i had no power sterring, we did manage to get the car back home without having an accident, had the car towed to ford dealership and they were able to fix it, well less than 6 months later i was driving my car again and all of a sudden no warning i had no power sterring, had it towed again to dealership and this time they found a diffrent problem, that caused the car to do the exact same thing as before they told me it would cost almost 2000 dollars to fix it, i am a traveling nurse and i depend on my car and my patients depend on me to be able to come see them, i would appreciate if something could be done i am scared of that car in my opinion it is a death trap, i wander how many people have had a crash due to this problem, thank you for your attention to this matter ……lisa Linda July 17, 2014 I own a 2010 Ford Fusion and have had the power steering go out while driving. Luckily, I am very strong and was able to get the car to a safe place without incident. The steering rack was replaced under warranty and less than 100 miles after picking up the “fixed” car, the exact same problem occurred. My mechanic will not touch it after that and referred me to Ford where the car is currently being diagnosed. I am not happy that Ford has not acknowledged this issue publically. They are putting many lives at risk for the sake of the almighty dollar. Bev July 15, 2014 I live in Canada. My son has had the same problem with his car,but ford keeps telling us it isn’t an issue with all of these make of cars just his.I have found many complaints on line from customers. Any suggestions what to do. Gina July 15, 2014 I have a 2012 Ford Fusion. The power steering has been going out, just like this article has described, while backing out of my garage. Tonight I was driving on a road near my house and my power steering went out. I was fortunate enough to be at a pullover spot. My son and I both had to pull on the steering wheel to get pulled over into a parked position. When I turn my engine off then on again the power steering comes back on and I’m able to drive for another 50 to a hundred miles before it happens again. Tonight it really scared me! I drive on a very busy highway 55 miles to work everyday if I had been on my way to work I feel certain I would have been in an accident an seriously injured, if not killed. Thank you for doing something about this.
