AT&T Data Breach Lawsuits Seek Damages for 70M Customers Whose Information Was Released

Following a massive cybersecurity hack that exposed the personal information of roughly 73 million customers, a growing number of AT&T data breach lawsuits are now being filed against the service provider, after the stolen data was leaked and posted publicly on an internet hacking forum last month.

AT&T first became aware of a potential data breach in 2021, when the hacker group Shiny Hunters claimed to have compromised the company’s systems, and were attempting to sell a database containing sensitive customer information. Initially, AT&T contested the legitimacy of these claims, stating that the samples of the leaked data provided by Shiny Hunters did not correspond to their records.

Rather than investigating the potential leak of millions of client records and notifying customers and regulators, the lawsuits claim AT&T continued to deny the validity of the breach until March 2024, when a hacker known as “MajorNelson” leaked the entire database for free.

AT&T Admits to Data Breach

It was only after the sensitive client information was publicly released that the telecom giant launched an investigation and admitted the data did indeed belong to their customers.

In a press release issued by AT&T on March 30, the company disclosed that the data breach exposed the names, addresses, phone numbers, Social Security numbers, and email addresses of approximately 7.6 million current account holders and approximately 65.4 million former account holders.

According to AT&T, the exposed data dates back to 2019 and earlier. However, the company has yet to identify the source of the unauthorized access to its systems that resulted in the massive release of customer data.

Although the AT&T data breach occurred years ago, the service provider has just now started sending Notice of data breach letters and emails to customers who had their social security numbers, dates of births and other sensitive personal information released. AT&T stated they are also offering complimentary identity theft and credit monitoring services to customers, but AT&T data breach lawsuits filed in recent weeks seek substantially more in damages for those impacted.

According to allegations raised in a number of different AT&T customer class action lawsuits, the telecom giant failed to adequately protect customer data and did not providing timely, adequate notification about the data breach, thus exposing customers to a greater risks of identity theft and fraud.

In one of the first complaints (PDF) filed on April 2, Alex Petroski seeks certification of a class action lawsuit against AT&T in the U.S. District Court for the Northern District of Texas, claiming that the data breach was a direct result of AT&T’s failure to implement adequate and reasonable cyber-security procedures and protocols necessary to protect consumers’ personally identifiable information (PII) from a foreseeable and preventable cyber-attack.

Petroski claims AT&T handled PII in a manner that was not only reckless, but also vulnerable to cyberattacks. The complaint states that AT&T was allegedly aware that their methods of transmitting and storing PII could easily be compromised, yet failed to take adequate steps to secure this sensitive data were not implemented, leaving it exposed to potential cyber threats.

The complaints further states AT&T failed to provide timely and accurate notification to the plaintiffs and other class members about the breach, which could have mitigated some of the damages earlier.

More than a dozen similar AT&T data breach lawsuits have similarly been filed, each raising similar allegations and seeking damages for different categories of customers. In addition, lawyers expect a number of individual claims to be pursued as well, seeking financial compensation for those who had their social security number or other sensitive information published.

Petition to Consolidate AT&T Data Breach Class Action Lawsuits

Given common questions of fact and law raised in complaints now being filed throughout the federal court system, a motion to transfer (PDF) was filed with the U.S. Judicial Panel on Multidistrict Litigation (JPML) earlier this month, requesting claims filed throughout the federal district court system be consolidated for pretrial proceedings before one judge as part of an AT&T data breach lawsuit MDL (multidistrict litigation).

The motion, also filed by Petroski, requests the litigation be consolidated in the Northern District of Texas, where the majority of complaints have been filed. According to the motion, eleven lawsuits are currently filed in the Northern District of Texas, while only one has been filed in the Western District of Oklahoma.

Petroski argues that due to the extensive nature of the data breach and the likelihood of the litigation to grow in the coming months and years, it is appropriate to centralize the claims to streamline the process, prevent inconsistent rulings, and facilitate the proceedings for both the court and the involved parties.

If the JPML chooses to consolidate the lawsuits before one judge, pretrial proceedings will be coordinated to avoid duplicative discovery into common issues in the cases, and the court will likely establish a bellwether program where a small group of cases will be prioritized, to help gauge how juries may interpret expert testimony and evidence likely to be used in thousands of trials.

    I’m a victim of AT&T data breach. I haven’t used AT&T services since the late 90’s or early 2000’s. I found out that my SSN had been compromised by another monitoring service. I spent 2 to 3 days trying to find out why I wasn’t contacted by AT&T. Well today 4/22/2024, I was told by their Global office that they are only contacting their existing customers and offering them monitoring service. I was told since I am no longer a customer I could monitor my credit myself. I feel that AT&T should be responsible for ALL people affected by this breach. I feel the least they could do is pay for the monitoring of ALL people credit.

    Currently an AT&T business customer. I was emailed of data breach. 1 extra line and phone on the account iPhone 11 Pro which I never ordered or received. Had 2 company emails I had to shut down due to phishing emails and calls. All my personal identifying information leaked on the dark web. Business bank accounts shut down due to unauthorized transactions. Payroll payments were rerouted. Fraudulent invoices made. I’ve had to hire credit repair companies to try and help. Was charged last year for a bounced check from my business account due to funds being transferred to another account. Had to plead guilty and accept a deferred judgment only if amount was paid. Literally just had my Navy Federal credit card account closed due to Fargo Police Department in ND contacting them and informing bank that my bank info and card was found on individual in their custody. Oh and I’ve somehow still got a personal account with AT&T with an outstanding bill of around $93.00 when all of my 4 devices I currently have on the account are on my business account. Absolutely no answers from AT&T only that they aren’t sure and I should talk to my bank which had to refund about $750.00 in unauthorized transactions in March of 2024. I could go on but I see that others are experiencing same issues. I encourage everyone affected to DOCUMENT everything and if you can file claims with banks and credit repair companies so that you can show them that in every case the fraudulent charges and accounts were reported officially. File charges with local police as well as FTC, CFPB, and all 3 credit bureaus. No matter what you do make sure you have a verifiable record of it. Notarize anything that isn’t reported by an agency and be sure to remain patient and vigilant.

    I’ve been notified via credit credit card dark web credit monitoring my that my information was found and compromised due to this breach. I was also notified of a name, address and phone number of a Hispanic male using my SSN and DOB who’s living in Texas. I’m a white female that lives in WA, it also states that it’s due to this AT&T data breach. I’ve received their notice for Experian credit monitoring, I signed up and that service has yet to detect this problem. This is not good, on a side note I haven’t used AT&T for many, many years 20 ? 25 maybe more ?? …I couldn’t tell you what phone number I had that is associated with this breach. How can I find out if I’m eligible for more help to fix this problem without a phone number ??

    Experian sent me a email alert stated that my phone number, social security number was on the DARK WEB SITES and also that another alert about TransUnion was telling Experian a account was open from a company name IC Systems which I have never open before, I’m trying to get that information right now from Experian and TransUion about this account being open with out my consent. This just taken place with In the past Month of April 2024. Please help me with my claim to be apart of the law suit against AT&T. I’m MAD as HELL at AT&T. my phone is cut off with them and I been a customer with AT&T for 20years plus and all you are going to give me Is 1 year of some member ship offering monitoring service.     I’m very concerned about my information being compromised due to data breach. How was the people information leaked?? All I was offered a 1 year offer to credit monitoring. This does not help my social security number, address, date of birth being compromised.

    I Also gotta a letter from AT&T saying my information was compromised…I knew something was Wrong when I kept receiving Constant security malware emails ,like Every 5 moments…saying my phone had all these viruses…like All day long…getting emails about Amazon package that couldn’t be delivered due to Wrong address when I hadn’t ordered anything…AND THE SPAM CALLS ARE RELENTLESS NOW…WAY MORE THAN THE PEOPLE WHO I ACTUALLY TALK TO..     Google does a monitor of my info and it comes out that my SSN name DOB and all emails are compromised not only by at&t but also T-Mobile has hit me in the same data breach. My credit score was at 700 now im at 506. Found all these different credit checks as well as a new credit card in my name.
